Every year thousands of people across the United Kingdom suffer an injury. These injuries can be anything from injuries as a result of an accident at work to a road traffic accident to injuries as a result of medical negligence. If a person is injured through no fault of their own they may have the right to claim for personal injury compensation. If the claim is successful and compensation is awarded, not only can it compensate the person for the injury suffered, but also take care of any financial losses as a result of the accident, for example medical costs or loss of earnings if the person had to take time off work. Claiming for personal injury compensation can also be a means of preventing the same accident happening to someone else. By making such a claim, attention is brought to the correct person/authority about the accident. For example, if a person is injured as a result of tripping on a loose pavement slab, making a claim could ensure that the council addresses the issue and take action to make the area safe.

If a person intends to make a claim for personal accident compensation, certain actions should be taken in order to increase the potential success of the claim. These include:

  • Inform the police if necessary, for example, if a person is involved in a road traffic accident
  • If the injury is a result of a road traffic accident the insurance company should also be notified. If a person fails to do this, the insurance policy may be invalid.
  • Inform a doctor for both health reasons and in case the claim is taken to court; the doctor will be asked to provide a medical report if this is the case.
  • Gather as much evidence as possible at the scene of the accident where necessary. Photographic evidence and the names and address of any witnesses could strengthen the claim and subsequently the amount of compensation awarded.
  • Write a personal account of the accident if possible while the details are fresh in the persons mind.

If a claim is successful, the amount of compensation awarded differs depending on factors such as the type of accident, the damages and losses suffered by the victim and the time it took for the person to heal (if at all). Once these issues have been assessed, the injury compensation is valued by making comparisons to similar cases and adjusting them as required. However, if it is decided that the claimant themselves was also partly responsible for the accident, for example not wearing a seatbelt when involved in a car accident, it is likely to reduce the amount of compensation awarded.
